An article on compulsory licensing by Katri Paas published the European Intellectual Property Review

An article “Compulsory licensing under the TRIPS Agreement – a Cruel Taunt for Developing Countries?” by senior associate Katri Paas was published in the December 2009 issue of European Intellectual Property Review.

The article discusses the controversy between the interests of pharmaceutical companies and those of developing countries in need of vital medicines. The article looks at the measures taken to solve this controversy in the context of the TRIPS Agreement. It is questioned whether the TRIPS Agreement compulsory licensing regime which has been put into place after heavy negotiations is not in fact a cruel taunt for the needy.
